I think it should be somewhat modeled on the home brew idea. You can grow enough to support one person's average (little more for two) use but you can't sell it. I think the limit is 100 gallons for beer/wine with a little more in a two person house (200gal). Fairly good amount of beer for a hobby. Don't know what the best limit for pot is under this scenario, since I'm not a smoker. Fifty pounds a year for a two person hosehold? I do home-brew beer and the limit is not enforced, (if so I don't know how) but the time it takes from mash to wort to secondary fermentation I don't have time to brew more than 200 gals a year, can't drink it all or have a place to put it. I'm sure it would be obvious if I went over. I would restrict growing marijuana to within the house, not outside in the backyard like tomatoes. Interior production being in a single family residence, not a warehouse!
You can give home-brew away, but selling is a no-no. So you could give away a joint to an adult, but not a plant. Having a legal consumption age of 21 to mirror alcohol would be reasonable. Nor could you smoke it in a public indoor establishment or anywhere cigarettes are not smoked (Schools, eg.) It would lessen the impact of crime for the substance. Penalties for selling it under 2 ounces would be a ticketed offense (misdemeanor $200 fine) for 5 offenses (akin to insurance points), 6+ being it would result in a felony conviction, but not a harsh prison sentence (stiff fine, substance abuse program and community service). We need to take the market away from opportunistic criminals and put in the hands of users who grow for themselves.
I disagree with having bars and establishments sell it, as it has the potential for abuse. Make people responsible for their individual use, not businesses as they would need an inventory and it becomes a management, regulation and control issue. You can smoke in private clubs that require a membership. Under no circumstance can it be sold in the establishment.
If you plow into someone which results in physical injury it's a DWI, property damage is a normal driving citation or ticket which results in a misdemeanor.
Since the government isn't going to get real about marijuna due to the steady stream of of license plate stampers it produces, it will continue to be an issue. People convicted of violent crimes can and have gotten less time than minor drug offenders. How is this justifiable? If I have to live in a semi-facist state, can't I just enjoy joint and a bag of Doritos?
